The Supreme Court recently decided a case that prohibits merchants from steering customers to (or away from) certain credit cards.  Specifically,  a challenge was made that American Express's restrictions on steering customers away from its cards were unconstitutional.  As the Court noted, American Express charges merchants more when they use its cards than it does when a customer uses a Visa or MasterCard charge card.  The case is Ohio v American Express . www.JackRoseLaw.com  Posts in this blog contain discussions of general principles of law and cases. In a startling case, the Supreme Court has found that States can collect sales tax from out of state retailers that do not have a presence in that state. While the impact of the case is not clear, it does appear to provide states with a new source of tax revenue.
